The petitioner seeks bail in connection with Rahui Police Station Case No. 35 of 2017 registered for offences punishable under sections 341, 323, 307, 354(B), 379, 504 and 506/34 of the Indian Penal Code.

It has been submitted that the petitioner and informant are agnates and on account of political rivalry, the entire family members of the petitioners have been roped in this case with false and frivolous allegation. The allegation of outraging modesty of informant who happens to be a Mukhiya, and taking away Rs.10,000 from the box of the informant appears omnibus. The petitioner allegedly caused simple injury and there was no

Patna High Court Cr.Misc. No.43564 of 2017 (2) dt.20-09-2017 2/2 repetition of blow. He is in judicial custody since 25.07.2017 having no antecedent except one case registered under section 47 (E) of the Excise Act.

Considering the facts and circumstances of the case, the petitioner- Vijay Chaudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Nalanda at Biharsharif in connection with Rahui Police Station Case No. 35 of 2017.
