JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Maniyari P.S. Case No. 95 of 2018 instituted for the offence under Sections 363, 366(A) and 34 of the Indian Penal Code.
Counsel for the petitioner submits that sister of informant had voluntarily gone with son of the petitioner namely Jitender Kumar and has performed marriage with him. Counsel for the petitioner further submits that sister of informant has sworn an affidavit before Notary Public, Muzaffarpur (Annexure2) wherein she has stated that she has solemnized marriage with Jitendra Kumar, son of petitioner, in Goddess Lakshmi Temple, situated at Lakshmi Chowk, Muzaffarpur.
Petitioner is father of Jitendra Kumar.
Patna High Court Cr.Misc. No.49859 of 2018 (3) dt.01-10-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Nayan Kumar, learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Maniyari P.S.
