The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per allegations in the FIR, the three accused persons on the motorcycle assaulted the informant with the butt of the pistol as a result of which he fell down unconscious. They took away the bag given by his chachi which contained money. It is submitted by learned senior counsel appearing for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation when he was arrested in one another case and his confessional

Patna High Court CR. MISC. No.3129 of 2021(6) dt.06-09-2021 2/2 statement was recorded by the police. No incriminating article has been recovered from his possession and inspite of being in custody since 20.4.2020 no T.I. parade has been conducted and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 1 year 4 months, the petitioner is directed to be enlarged on bail in connection with Sonbarsha P.S. Case no. 56 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Sitamarhi.
