The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 18.01.2017 passed in Cri. Misc. No. 1575 of 2017, on the ground that the petitioner is suffering in custody since 08.04.2016, there is no specific allegation against the petitioner and further identification of the petitioner appears doubtful. Up till now two prosecution witnesses have been examined and both have turned hostile and, as such, in near future the trial is not likely to be concluded. The learned A.P.P. opposes the prayer of bail by submitting that the petitioner and other four co-accused were identified by the informant who had come 20-25 in number and
Patna High Court Cr.Misc. No.50761 of 2017 (3) dt.08-11-2017 2/2 had killed Makri Kora and Laxman Kora after leaving Naxali pamphlets.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, the learned trail Court is directed to expedite the trial and conclude the same preferably within six months, after taking the same on priority basis, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail.
