The petitioner seeks regular bail in connection with Jamo Bazar Police Station Case No. 50 of 2021, registered for the offences punishable under Sections 341/323/324/307/379/34 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that the petitioner assaulted the informant by means of farsha on his head, causing injuries to him. Learned Counsel for the petitioner submits that both the parties are co-sharers and there was a dispute between them relating to a trivial issue of taking away wood kept in front of the house of the informant. He further submits that from perusal of injury report (Annexure 2), it would be evident that the

He further submits that the petitioner is in custody since 01.07.2021, having no criminal antecedent and charge sheet has been submitted against him and as such, there is no likelihood that the petitioner will abscond and/or tamper with the evidence.

Regards being had to the submissions advanced on behalf of the parties concerned and taking into consideration the materials available on record and the fact that both the parties are co-sharers, injuries received by the informant are simple in nature, charge sheet has already been submitted and the petitioner is in custody since 01.07.2021, having no criminal antecedent, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan, in connection with Jamo Bazar Police Station Case No. 50 of 2021.
