Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Sheikhopur Sarai P.S. Case No. 66 of 2023 registered under Sections 30(a)/32(2)/41(1) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ill motive and oblique reasons. Further submission is that the alleged car in question from where the illicit liquor has been recovered does not belong to the petitioner. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of

No.42931 of 2023(2) dt.04-08-2023 2/2 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Judge, Sheikhpura in connection with Sheikhopur Sarai P.S. Case No. 66 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
