This is an application for bail in connection with Chiraiya P.S. Case No. 115 of 2017, registered for the offences punishable under Sections 366A and 120B/34 of the Indian Penal Code. Petitioners are said to be mother and brother of the main accused and allegation is of kidnapping against the main accused and allegation of conspiracy with main accused is against the petitioners.

Submission of learned counsel for the petitioners is that they are mother and brother of the main accused and, as such, they have been implicated in this case and girl has already been recovered and even she has not stated anything about these petitioners in her statement under Section 164 Cr.P.C. and they are in custody since 14.5.2017.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.50318 of 2017 (3) dt.10-11-2017 2/2 circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sikrahana at Dhaka, Motihari, East Champaran, in connection with Chiraiya P.S.Case No. 115 of 2017, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioners will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, their bail bonds shall be cancelled.
