1. Heard Mr. Sanjya Kumar Chaubey, learned counsel for the petitioner through virtual mode and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 384, 379, 504, 506 and 34 of the Indian Penal Code.
3. Learned A.P.P. at the outset submits that petitioner had earlier moved this Court seeking anticipatory bail by filing Cr. Misc. No. 72096 of 2024. It is further submitted that learned Advocate, Mr. Rajesh Roy, had appeared in Cr. Misc. No. 72096 of 2024 and after some argument, he withdrew the anticipatory bail application of the petitioner as would manifest from the order dated 29.01.2025 (Annexure-1). It is next submitted that the petitioner has again moved this Court seeking anticipatory bail by filing the instant criminal miscellaneous. It is, thus,
Patna High Court CR. MISC. No.47273 of 2025(2) dt.11-07-2025 2/2 submitted that this is the second attempt of the petitioner to seek anticipatory bail.
4. Learned A.P.P. further submits that with change of counsel, the petitioner cannot take a shifting stand.
5. Learned counsel appearing on behalf of the petitioner is not in a position to rebut the submission of the learned A.P.P.
6. The Court is in complete agreement with the submission made by the learned A.P.P.
7. The second anticipatory bail application of the petitioner is rejected in connection with Manjhagarh P.S. Case No. 142 of 2024 pending in the Court of learned Chief Judicial Magistrate, Gopalganj/Successor Court.
