06-10-2018 Heard Sri Bijay Prakash Singh, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, apprehending his arrest in Jamo Bazar P.S. Case No. 65 of 2018 registered for offence under Sections 272, 273, 308, 420, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that in this case, nothing was recovered from conscious possession of the petitioner, rather from a field, there was recovery of Indian make foreign liquor and petitioner has been made accused. He further submits that after the petitioner was made accused in the present case, again falsely he has been made accused in an another case, which fact has been stated in paragraph-3 of the
Patna High Court Cr.Misc. No.53627 of 2018(3) dt.06-10-2018 2/2 petition.
Considering the fact that nothing was recovered from conscious possession of the petitioner as well as nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Awadhesh Singh @ Awadhesh Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Jamo Bazar P.S. Case No. 65 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
