2. The petitioner is apprehending his arrest in Mahua P.S. Case No. 68 of 2025 registered under Sections 191(2), 126(2), 115(2), 118(1), 109, 351, 352, 303(2) of the BNS, 2023.

3. As per allegation, the petitioner along with other coaccused persons are said to have assaulted the informant and his father due to which they got badly injured. It is further alleged that accused persons snatched Rs. 85,000/- and a mobile from pocket of the informant's father.

4. It has been submitted on behalf of the petitioner that the petitioner is innocent and has falsely been implicated in the present case. Learned counsel for the petitioner has submitted that both the parties are agnates and there is land dispute between the

Patna High Court CR. MISC. No.42740 of 2025(4) dt.27-11-2025 2/2 parties for which title suit is pending. Civil litigation and criminal litigation are pending between the parties. It has further been submitted that although, injury on the person of the informant is grievous in nature but it is not assigned/attributed to the present petitioner. The specific allegation against the petitioner is that he assaulted father of the informant on his back with blunt portion of axe but no injury is there in the case diary.

5. Learned APP and learned counsel for the informant have opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Vaishali at Hajipur in connection with Mahua P.S. Case No. 68 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
