ANJANA MISHRA ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Sonbarsa P.S. Case No. 47 of 2014, registered for offences punishable under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the entire F.I.R is a version which has been narrated by the nephew of the informant, namely, one Puttu Kumar. Admittedly, the son of the informant sustained injuries while the Barat procession was going towards the wedding venue. There are no eyewitness in the case. Furthermore, the petitioner is not named in the F.I.R and subsequently on the basis of statement made during the course of investigation that the petitioner was also one of the members of the Barat, he has been roped into the present case. Considering the

No.47330 of 2015 (2) dt.19-01-2016 2 / 2 nature of allegation made against the present petitioner, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 47 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
