The petitioner seeks bail in a case registered for offences under Sections 38, 41, 47, 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 84 litres of foreign liquor were allegedly recovered from the house of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 13.07.2017.
Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on
Patna High Court Cr.Misc. No.40533 of 2017(2) dt.25-08-2017 2/2 bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur in connection with Musarigharari P.S. Case No. 63 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
