Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Mushahri P.S. Case No. 96 of 2023 registered for the offence under Sections 392 of the Indian Penal Code.

As per the prosecution case, an amount of Rs. 2,55,171/- was looted by criminals while it was being taken to the Bank after collection. The petitioner is said to be one of the criminals involved in the loot.

Learned counsel for the petitioner has submitted that the petitioner has clean antecedent and he is in custody since 30.04.2023 and he also offers to pay Rs. 85,000/- in the Ujjiwan Small Finance Bank, Kalambag Road, Muzaffarpur. In view of the aforesaid and also considering the period of custody, this application for regular bail is allowed.

No.45970 of 2023(2) dt.19-08-2023 2/2 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class (East), Muzaffarpur in connection with Mushahri P.S. Case No. 96 of 2023.

At the time of furnishing bail bond the petitioner shall deposit a demand draft of Rs. 85,000/- issued in favour of Ujjiwan Small Finance Bank, Kalambag Road, Muzaffarpur. If such a demand draft is deposited in the Court below, the petitioner shall be released on bail.

The said demand draft will be handed over to the official of the Bank, after due verification. The petitioner will visit Mushahri Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
