====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-07-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.
3. As per F.I.R., this petitioner grabbed compensation amount of Rs. 3,22,287/- which was given to informant by the company due to the death of her husband.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. As a matter of fact, no amount of compensation has been given by the company at the relevant time nor there is any chit of paper to support the prosecution case. During course of investigation it has come that in the year 2014 itself, informant has received amount of service benefits of her late husband through Embassy
Patna High Court CR. MISC. No.45617 of 2024(2) dt.30-07-2024 2/2 of India and this petitioner has been made accused only with an intention to humiliate and harass the petitioner. Petitioner claims clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Gopalganj in connection with Uchkagaon P. S. Case No. 495 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
