The petitioner seeks bail in G.R.P. Bakhtiyarpur P.S. Case No. 28 of 2019, instituted for the offence under Section(s) 341, 323, 343, 504 and 379/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Shiv Kumar.

Petitioner is in custody since 22.3.2019.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.41239 of 2019(3) dt.02-09-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Patna, in connection with G.R.P.
