2. This is the second attempt of the petitioner for grtant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 16.10.2023 passed in Cr. Misc. No. 66499 of 2023 which reads as under:- Heard learned counsel for the petitioner and Mr. Ashok kr. Singh, learned APP for the State.

2. This application for grant of regular bail arise out of Dehri (Town) P.S. Case No. 746 of 2021 registered for the offence punishable under Sections 302, 34 of the Indian Penal Code read with Sections 27of the Arms Act.

3. As per F.I.R, the deceased was killed by unknown criminals.

4. During investigation the materials including the CCTV footage from which petitioner has been identified as one of the accused who has participated in killing of the deceased.

5. In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the prayer of bail of the petitioner is rejected herewith.

7. The Trial Court is directed to expedite the trial.

3. Upon perusal of the earlier order, the materials available on record and the impugned order, this Court finds no new ground to review its earlier order.
