The petitioner apprehends his arrest in a criminal prosecution registered under Sections 419,420/34 of the Indian Penal Code as also under Sections 20,21,22,23 of N.D.P.S. Act, 1985.

Taking into consideration the fact that the petitioner is named in the F.I.R vide Annexure-1 as an accused with specific allegations against him with respect to the commission of crime under the provisions of N.D.P.S. Act, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Gandhi Maidan P.S. Case No. 483 of 2013, corresponding to Special Case No. 86 of 2013 pending in the Court of the learned Additional Sessions Judge-VII, N.D.P.S., Patna, is rejected.

However, if the petitioner surrenders in the court below within a period of four weeks from today and, if he applies for regular bail, then the same shall be considered and decided on its

Patna High Court Cr.Misc. No.48013 of 2015 (3) dt.29-01-2016 2/2 own merit without being prejudiced by the rejection of his prayer for anticipatory bail by the present order.
