The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 302/34 of the Indian Penal Code and Section 25(1-A), 26, 27 of the Arms Act.

It is a case of commission of murder of the husband of the informant by opening fire by the petitioner and other accused persons.

It is submitted by learned counsel for the petitioner that in the background of some political rivalry, the present F.I.R has been registered. There is counter version of the occurrence also and the case

Patna High Court CR. MISC. No.51894 of 2021(7) dt.08-09-2022 2/3 registered by the petitioner's side is at earlier point of time.

In contra, learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that petitioner is named in the F.I.R. There is specific accusation of opening fire to the deceased against the petitioner due to which he succumbed to the injuries. The postmortem report as well as the statement of the witnesses corroborate the prosecution case.

In the facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.

The petitioner is directed to surrender before learned Court below and pray for regular bail. The learned Court below may consider the prayer for regular
