The petitioners apprehend their arrest in Chainpur P.S. case No. 101 of 2016 under Section 307, 325 and other Sections of the Indian Penal Code.
The informant alleged that while he was burning hush in his field, Rajesh Singh, Jay Kunwar Singh, petitioner No.1, came and begun to abuse the informant and they assaulted the informant with Lathi. When Awadhesh Singh, son of the informant, came to save Sunil Singh and Anil Singh, petitioners Nos. 2 and 3, are said to have assaulted Awadhesh Singh. It is submitted that there is counter version of the occurrence being Chainpur P.S. case No. 102 of 2016. Rajesh
Patna High Court Cr.Misc. No.28700 of 2016 (3) dt.05-09-2016 2/2 Singh is informant of the aforesaid case in which mother of petitioners Nos. 2 and 3 got injuries on account of assault made by informant and others. Rajesh Singh and Jay Kunwer Singh are alleged to have assaulted the informant with Lathi but out of five injuries only one injury, that too on ulna, was found to be grievous as there was fracture. Awadhesh Singh got two simple injures. Considering the fact that there is land dispute between the parties and both sides assaulted each other, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in Chainpur P.S. Case No. 101 of 2016 (G.R. No. 1123 of 2016), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
