The sole petitioner, who is in custody since 21.05.2017 in Rail P.S. Jhajha Case No.123 of 2017 registered for the offence under Sections 30(a)/38(1) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. By way of referring to the statement made in paragraph no.3 of the petition, it was submitted by learned counsel for the petitioner that the petitioner is having clean antecedent and on false accusation of recovery of about 9 Liters of Indian Make Foreign Liquor, the petitioner was apprehended and he is languishing in jail custody.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely, Mithlesh

Patna High Court Cr.Misc. No.39599 of 2017 (2) dt.19-06-2017 2/2 Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D,J-II, Lakhisarai in connection with Rail P.S. Jhajha Case No.123 of 2017.
