The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

It is a case of recovery of about 375 liters of English wine from the two vehicles and the petitioner having two similar cases in the same nature of offence.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no recovery from the conscious or constructive possession of the petitioner and he has not been apprehended at the spot and he has no concern with the seized liquor or vehicle.

Patna High Court CR. MISC. No.52807 of 2021(3) dt.22-06-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In view of the aforesaid facts and circumstances of the case as well as the fact that the petitioner has two similar cases in the same nature of offence, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail of the petitioner is disposed of.
