Mr.Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 27-06-2024 At the outset, learned counsel for the petitioner seeks permission to make necessary correction in this bail petition.

2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 462 of 2023 instituted for the offences under Sections 147, 148, 341, 323, 324, 307, 354A, 379, 504 and 506 of the Indian Penal Code.

4. The allegation against the petitioner along with others is of assaulting the informant due to which he sustained injury.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.44694 of 2024(2) dt.27-06-2024 2/2 present case. There has been delay of about 21 days in lodging the FIR. There is general and omnibus allegation against the petitioner rather the specific allegation of assault is against coaccused Shankar Das. There is no specific overt act of assault alleged against the petitioner. No incriminating article has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 01.04.2024 and has no criminal antecedent.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. Considering the facts and circumstances of the case as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bibhutipur P.S. Case No. 462 of 2023.
