The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 307, 354B, 448 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.
The informant alleges that accused persons, including the petitioner, came to her house and assaulted and disrobed her and also touched her inappropriately and this petitioner along with other accused persons were also firing, it is next alleged that the accused persons assaulted Vikash who came to save the informant.
Learned counsel for the petitioner submits that the petitioner has antecedent of one case and has been falsely

No.42647 of 2022(2) dt.26-09-2022 2/3 implicated in the present case, it is next submitted that petitioner is son-in-law of Aditya Singh who is father of Aradhna Singh, it is further submitted that the husband of the informant had filed a Title Suit No. 103 of 2022 which is pending before the learned trial court at Bhabhua against the father-in-law of the present petitioner and others, it is thus submitted that since this petitioner had come to his matrimonial home as such he also came to be implicated with a general and omnibus allegation that he was indulging in firing.
Learned counsel further submits that it absolutely does not stand to reason that if the petitioner along with other accused was indulging in firing, as alleged, but then there was no injury from the side of the prosecution, it is also submitted that Ramgarh P.S. Case No. 59 of 2022 has been instituted by mother-in-law of the petitioner against the informant and others, it is thus submitted that the present case is a counterblast to Ramgarh P.S. Case No. 59 of 2022. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.42647 of 2022(2) dt.26-09-2022 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ramgarh P.S. Case No. 60 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
