JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Korha P.S. Case No. 71 of 2016 for the offences instituted under Sections 341, 323, 324 and 307/34 of the Indian Penal Code.
As per prosecution case, it is alleged by the informant that on 10.04.2016 at about 1.30 P.M., the informant and his brother unloading the compost in his field, in the meantime, the accused persons came there and assaulted his brother Rajesh Kumar with fists, lathi and knife, due to which, his brother
Patna High Court Cr.Misc. No.27392 of 2016 (2) dt.12-07-2016 sustained injury, thereafter he referred to the Sadar Hospital, Katihar.
It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. The father of petitioner no.2 happens to be the Sikmidar of the informant which is evident from Annexure-3 to the present application and for the said reason, the informant has been repeatedly instituting the false cases against the petitioners. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Korha P.S. Case No. 71 of 2016 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
