ANJANA MISHRA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Sour Bazar P.S. Case No. 48 of 2015 registered for the offence under Section 420 of Indian Penal Code. Learned counsel for the petitioner submits that allegation against three accused persons namely Sanjay Kumar Sharma @ Sanjay Choudhary, the present petitioner namely Vijay Kumar Singh and one Rajesh Sah who were said to have taken 263.20 quintals of maize grain amounting to Rs. 2,98,732/- from the informant. It is alleged that petitioner and others have only returned Rs. 50,000/- of the said maize grain with permission to give the rest amount within three days. It is further stated that
Patna High Court Cr.Misc. No.32791 of 2016 (2) dt.09-09-2016 delay in filing of F.I.R., no reason has been mentioned by the informant. It is further submitted that one of the co-accused namely Sanjay Kumar Sharma @ Sanjay Choudhary has been extended privilege of anticipatory bail in Cr.Misc. No. 6841 of 2016 vide order dated 14.03.2016.
Under the facts and circumstances of the similar nature of the case, the above named petitioner in the event of his arrest/surrender within a period of four weeks from the date of receipt of copy of order shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 48 of 2015, subject to condition as laid down under Section 438
(2) of Cr.P.C.
