The petitioner seeks regular bail in connection with Special Case No.4038 of 2017 arising out of Kankarbagh P.S.Case No.523 of 2017 registered for offences punishable under Sections 272 & 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 216 bottle of 750 ml. each foreign liquor.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. The petitioner has no criminal antecedent and he is in custody since 20.7.2017.

Having heard both sides and in view of the

Patna High Court Cr.Misc. No.46076 of 2017 (2) dt.19-09-2017 allegation, this application is disposed of with direction to the learned trial court that once the charge is framed in this case or the petitioner completes three months judicial custody, whichever is earlier, he shall release the petitioner in connection with Special Case No.4038 of 2017 arising out of Kankarbagh P.S.Case No.523 of 2017 to his own satisfaction.
