====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner, informant and the learned A.P.P. for the State.
The petitioner seeks bail in Tiyar P.S. Case No. 39/2017, instituted for the offences under Sections 341, 323, 325, 379, 307 and 504/34 of the Indian Penal Code. It is alleged in the written report that one Ramlal Yadav along with this petitioner assaulted the informant and his family members when the informant was going to his field. Learned counsel for the petitioner has submitted that instant case is counter blast of Tiyar P.S. Case No. 02/2018, which has been lodged on the basis of complaint filed by Rita Devi (daughter-in-law of the petitioner) against the informant of the present case and others. It is further submitted that aforesaid
Patna High Court Cr.Misc. No.55897 of 2018 (3) dt.31-10-2018 2/2 Ramlal Yadav has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 63051/2018 dated 25.10.2018.
Learned counsel for informant has opposed the prayer of bail of the petitioner.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Ara in connection with Tiyar P.S. Case No. 39/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
