The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kopa P.S. Case no. 129 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

As per allegation in the FIR, petitioner is a member of unlawful assembly and has assaulted the members of the prosecution party.

It is submitted by learned counsel for the petitioner that there is general and omnibus allegation against the petitioner. He is innocent and has committed no offence. There is case and counter case. Similarly situated co-accused Sanjay

Patna High Court CR. MISC. No.39433 of 2020(3) dt.25-10-2021 2/2 Ram has been granted anticipatory bail by an another Bench of this Court vide order dated 8.7.2021 passed in Cr. Misc. No. 1911 of 2021 and co-accused Santosh Ram and others have also been granted bail by another Bench of this Court vide order dated 30.7.2021 passed in Cr. Misc. No. 3827 of 2021. Learned APP appearing for the State has opposed the prayer of bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kopa P.S. Case no. 129 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V Saran at Chapra subject to the conditions as laid down under section 438(2) of the Cr.P.C.
