JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Dalsingh Sarai P.S. Case No. 288 of 2014 for the offences under Section 302/34 of the Indian Penal Code.

From the F.I.R. it appears that allegation against the petitioner and co-accused is that they strangulated the husband of the informant. This petitioner and her husband are suspected in the commission of the crime by the informant, however, the husband of this petitioner, namely, Md. Kalam, has already been granted bail by this Court in Cr. Misc. No. 51443 of 2015, vide order dated 14.03.2016.

The case of this petitioner is similar to that Md. Kalam, who has been granted bail by this Court in Cr. Misc. No.

Patna High Court Cr.Misc. No.35853 of 2017 (2) dt.10-08-2017 2/2 51443 of 2015, vide order dated 14.03.2016 and also considering the fact that the petitioner is in custody since 17.03.2017, I am inclined to enlarged the petitioner, above named, on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalsing Sarai, Samastipur in connection with Dalsingh Sarai P.S. Case No. 288 of 2014, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
