JUSTICE RAKESH KUMAR ORAL ORDER 29-08-2016 Heard Sri Pramod Kumar Singh, learned counsel who was assisted by Sri Parmanand Prasad Narain Shahi, learned counsel for the petitioners and Sri Nawal Kishore Prasad, learned Additional Public Prosecutor.
At the very outset learned counsel for the petitioners makes a prayer for disposal of the bail petition so far petitioner no. 2 to 4 are concerned so that petitioner no. 2, 3, 4 namely Kanhaiya Kumar, Ashok Singh and Sudhir Singh may appear before the court below and make a prayer for regular bail.

No.31918 of 2016 (2) dt.29-08-2016 2/2 Accordingly the bail petition so far petitioner no. 2, 3 and 4 namely Kanhaiya Kumar, Ashok Singh and Sudhir Singh is concerned is hereby dismissed as withdrawn with observation that if they appear before the court below and make a prayer for regular bail within a period six weeks from today the learned court below may examine the same pass appropriate order in accordance with law preferably on the same day. So far petitioner no. 1 and 5 are concerned, they are lady. It was submitted by learned counsel for the petitioners that in family dispute petitioners have been made accused. Keeping in view the fact that they are lady and the nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner no.
1 Mamta Devi @ Mamta Kumari and petitioner no. 5 Tanik Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai / concerned court in connection with Surajgarha P.S. Case No. 42 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
