The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code.

As per the prosecution case, the complainant executed a sale deed in favour of petitioner with respect to a land vide sale deed no. 6138 dated 09.04.2013 for a consideration amouint of RS. 5,00,000/-, but this petitioner paid only Rs. 2,70,000/- and for rest money petitioner made an agreement to pay the balance amount by 31.12.2013 to the complainant, but the petitioner failed to make payment.

No.43189 of 2022(3) dt.08-12-2022 2/2 It is submitted that after receiving the entire consideration money the complainant executed the sale deed in favour of petitioner and only with a view to put pressure and extort money this false and concocted case has been lodged. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Katihar in connection with CA Case No. 488 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
