This is an application for bail in connection with Dihri Town P.S. Case No. 114 of 2001, corresponding to Sessions Trial No. 690 of 2002, registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code. This is a case of misuse of privilege of bail for 10 years. Submission of learned counsel for the petitioner is that he had gone outside State4 for earning his livelihood and as such he could not make pairvi in the case. Further submission is that he is in custody for six months and he is ready to abide by any condition that may be imposed on him by this Court if bail is granted to him.

Having heard both sides and in view of long misuse of privilege of bail, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within a period of five months. If trial is not concluded within the said period, learned trial court shall release the petitioner on bail to its own satisfaction on the condition that he will co-operate in trial.
