This application is for grant of regular bail arises out of Dagarua P.S. Case No.61 of 2025 registered for the offence under sections 8(c) and 21(b) and 29 of the N.D.P.S. Act.

As per the F.I.R., the recovery is of 70 grams of smack from co-accused - Wajid. There is no recovery from the petitioner.

The petitioner is in custody since 20.02.2025. He claims clean antecedent.

Considering the fact that there is no recovery of smack from the petitioner and also considering the period of custody of the petitioner, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S., Purnea / concerned Court below, in connection with Dagarua P.S. Case No.61 of 2025. 7.

At the time of accepting the bail bonds of the petitioner, the Court below shall verify the fact whether the petitioner has clean antecedent or not. If it is found that the petitioner has clean antecedent then only his bail bonds shall be accepted by the Court below.

This is also subject to the condition that the petitioner shall mark his attendance at Amour Police Station, Purnea on first and third Sunday of each month. Any default in appearance at the police station would result in the cancellation of bail bonds of the petitioner.
