2 The petitioner has preferred this application for grant of regular bail in connection with Araria (Bairgachhi) PS Case No 1118 of 2022 dated 19.12.2022 registered for the offence punishable under Section 392 of the IPC. 3 As per the prosecution case, three unknown miscreants came on a motorcycle and snatched Rs 2,32,500/- from the informant.

4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has one criminal antecedent, as stated in paragraph 3 of the bail petition in which he has been acquitted.

No.42954 of 2023(2) dt.20-07-2023 2/2 It is further submitted that the co-accused Md Aslam has already been granted bail by the co-ordinate Bench of this Court vide order dated 11.05.2023 passed in Cr Misc No 13885 of 2023. The petitioner is in custody in this case since 21.12.2022. 5 Learned APP has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of CJM, Araria in Araria (Bairgachhi) PS Case No 1118 of 2022 dated 19.12.2022. 7 This application stands allowed.
