Mr. Sri Arun Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Manigachi P.S. Case No. 91 of 2018 registered under Sections 363 and 366(A) of the Indian Penal Code. The accusation is of kidnapping the daughter of the informant, aged about 17 years, by this petitioner for performing the marriage while he had gone to purchase the vegetable in the market.

Learned counsel for the petitioner submits that, in fact, daughter of the informant is major, who left her parental house and performed the marriage with the petitioner according to her own sweet will which has come in her statement recorded

Patna High Court Cr.Misc. No.53963 of 2018(3) dt.28-09-2018 2/2 under Section 164 Cr.P.C., as detailed in paragraph 75 of the case diary. Moreover, the age of the victim, daughter of the informant, was also assessed by the medical board in between 17-19 years.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Darbhanga, in connection with Manigachi P.S. Case No. 91 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
