Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 16.11.2017 passed in Cr. Misc. No.51902 of 2017.
The allegation against the petitioner is of committing rape upon the minor daughter of the informant. Submission of the learned counsel for the petitioner is that he is in custody since 15.6.2017 and up-till-now the charge has not been framed against him and he has been falsely implicated in this case as the father of the petitioner runs grocery shop.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.59302 of 2018 (3) dt.03-10-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and if the charge is framed in this case, he will try to dispose of it expeditiously.
With the aforesaid observation, this application is dismissed.
