2. The petitioner seeks bail in connection with Hajipur Sadar (Kajipur) P.S. Case No. 927 of 2023 registered for the offence under Section 363, 366A/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are said to have kidnapped the victim girl.

4. It has been submitted by the learned counsel for the petitioner that the alleged victim girl has now got married with the son of the petitioner. He also submits that the petitioner is in jail since 22.1.2024.

5. It has further been submitted by the learned counsel for the petitioner that the alleged victim girl had filed an application in the Court of CJM, Vaishali at Hajipur saying that she is major and she had left her house on her own.

6. It has also been submitted by the learned counsel for the petitioner that the alleged victim girl had also filed an application before the Sessions Judge, Ludhiana for protection.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Sadar (Kajipur) P.S. Case No. 927 of 2023.

9. The Superintendent of Police, Vaishali at Hajipur is directed to trace out the victim girl so that her statement under Section 164 of the Cr.P.C. may be recorded in the Court and if it is found that she is major and she has left her house on her own then proper charge-sheet/final form may be submitted in the case.
