JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 15-10-2015 The petitioner apprehend their arrest in Kanti P.S. Case No. 115/2015, registered under section 302/34 of the Indian Penal Code.
From the order of the learned Sessions Judge it appears that there was fight between the two children and the families involved in altercation. The old lady when tried to pacify, she was pushed and she died on falling. The death was not homicidal. Learned counsel for the petitioners draws attention of this Court to the order of the learned Sessions Judge, wherein he has noticed that in course of supervision, the Deputy
Patna High Court Cr.Misc. No.47416 of 2015 (2) dt.15-10-2015 2/2 Superintendent of Police has found the case not established against the petitioners.
Be that as it may, considering the nature of the incident, I direct that in the event of arrest or surrender in the court below within four weeks, the above named petitioners shall be enlarged on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Subdivisional Judicial Magistrate West, Muzaffarpur, in connection with Kanti P.S. Case No. 115/2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
