For the Petitioner/s : Mr. Pramod Kumar For the Opposite Party/s : Mr. Sri Binod Kumar 3 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2016 Heard Sri Pramod Kumar, learned counsel for the petitioner and Sri Binod Kumar No.3, learned Addl. Public Prosecutor.
The sole petitioner, who is named as sole accused in the F.I.R. in Khajekalan P.S. Case no.289/2015 registered for the offence under Sections 376 and 511 of the Indian Penal Code, has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case due to the reason that there was some dispute with an old lady, who is the informant of the present case. On this ground he has prayed for grant of anticipatory bail. Learned Addl. Public Prosecutor, opposing the prayer for anticipatory bail, submits that on perusal of the order
Patna High Court Cr.Misc. No.26574 of 2016 (2) dt.04-07-2016 2/2 impugned, it is evident that number of witnesses have supported the prosecution case.
In view of facts and circumstances, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
