This application for anticipatory bail arises out of Chautham P.S. Case N0. 187 of 2018, disclosing offences under Sections 304B and 201/34 of the Indian Penal Code. It is alleged in the First Information Report that the victim is missing and based on suspicion that she might have been killed by her in-laws, the First Information Report has been registered. The petitioner is mother-in-law of the alleged victim.
Learned counsel for the petitioner has submitted that there is vague allegation of demand of dowry and, that too, not specific against the petitioner.
Considering the above submission, this application is allowed.
Let the petitioner above named in the event of her
Patna High Court CR. MISC. No.39340 of 2019(2) dt.27-06-2019 2/2 arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Chautham P.S. Case No. 187 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
