JUSTICE RAKESH KUMAR ORAL ORDER 05-10-2015 The sole petitioner, apprehending his arrest in connection with Fesar P.S. Case No.23 of 2015 registered for the offence under Sections 147,148,149,323,341, 324,307,379 of the Indian Penal Code and 27 of the Arms Act, has prayed for grant of anticipatory bail.

On perusal of the impugned order, it is evident that there is case and counter case in between the parties. From the petitioner's side also, an F.I.R. vide Fesar P.S. Case no.24/15 was registered for the offence under Sections 147,148,149, 341, 323, 324 of the Indian Penal Code. On perusal of the materials, particularly the order impugned, it is evident that both sides were related with each other and occurrence had taken place due to some property dispute. From the order impugned, it is further evident that injures were found simple in nature.

No.46995 of 2015 (2) dt.05-10-2015 2/2 In view of facts and circumstances, particularly the fact that there was case and counter case in between the parties, let the petitioner, namely, Sadhu Yadav, in the event of his arrest or surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Aurangabad in connection with Fesar P.S. Case no.23 of 2015 subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U
