This application is for grant of regular bail in connection with Lakhisarai (Kabaiya) P.S.Case no.193 of 2017 for the offences punishable under Sections 392/411 of the Indian Penal Code.
Petitioner is not named in the FIR and allegation against him is that he had taken the informant on his tempo and after going some distance, he looted articles including cash of Rs.27,500/- and on hull, he assaulted him. Later on, the police recovered looted articles from his possession. Apart from that he is accused in two more cases of similar nature.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and there is no
Patna High Court Cr.Misc. No.49514 of 2017 (3) dt.20-11-2017 2/2 eye witness of the occurrence. He is in custody for more than six months.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, hence, the prayer for bail of the petitioner is rejected, however, the learned trial court is directed to expedite the trial of the petitioner.
With the aforesaid observation, this application is dismissed.
