This application is for grant of regular bail in connection with Kharik P.S.Case No.38 of 2012 (G.R.No.310 of 2012) for the offences under Sections 385 & 387/34 of the Indian Penal Code. Allegation against the petitioner is about demand of extortion and he is named in the F.I.R.. It is stated that the villagers have identified him.

It is submitted on behalf of the petitioner that he is in custody since 30.11.2015 and there is likelihood conclusion of the trial in future.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of the fact that in this

Patna High Court Cr.Misc. No.36240 of 2016 (4) dt.08-05-2017 2/2 case, a report was called for and from perusal of the report, it appears that the charge has already been framed and the summon has been issued for production of the witnesses. Considering the aforesaid facts, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and if possible, the trial be conducted on regular basis, at the same time, the S.P., Naugachia is directed to ensure presence of the witnesses on the date fixed so that the trial be concluded.

With the aforesaid observation, this application is dismissed.
