The petitioner apprehends his arrest in connection with Islampur P.S. Case no. 47 of 2019, registered under Section 366 of the Indian Penal Code.

The accusation is that in the evening of 06.02.2019, daughter of the informant, aged about 17 years left the house. Before 15 days, the daughter of the informant, was seen talking with the petitioner, while informant tried to caught him but he fled away. The informant raised suspicion about kidnapping of his daughter by the petitioner. Learned counsel for the petitioner submits that it would appear from the F.I.R. that daughter of the informant fled away from his house, but none had seen her leaving the

Further submission is that informant raised only suspicion against the petitioner regarding kidnapping of his daughter. The informant has also filed an application in the Court of Addl. Chief Judicial Magistrate-III, Hilsa, Nalanda on 26.03.2019 to the effect that he had lodged the case only the basis of suspicion and later on he came to know that petitioner has not kidnapped his daughter. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-III, Hilsa, Nalanda in connection with Islampur P.S. Case No. 47 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
