ANJANA MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.06.2017 in connection with Mairwa P.S. Case No.166 of 2017 registered for the offence under Section 394/302 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted on behalf of the petitioner that neither the petitioner is named in the F.I.R. nor any recovery was made from his possession. Only on the basis of the confessional statement made before the police by one Vinay Kumar Singh, that the name of the petitioner has surfaced. However, there is no T.I. Parade and the petitioner has been languishing in jail on mere suspicion.
