This is an application for bail in connection with Nautan P.S.Case No. 14 of 2017 registered for the offences punishable under Sections 399, 402, 413, 414 of the Indian Penal Code and 25(1-B)(a), 26 & 35 of the Arms Act.

Allegation against the petitioner is of recovery of one country made pistil and four cartridges from his possession. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 22.1.2017. Further submission is that though he is made accused in six other cases but he is on bail in those cases. Heard learned APP also.

Having heard both sides and in view of the fact that

No.44360 of 2017 (3) dt.10-10-2017 2/2 though he is made accused in six other cases but he is in custody in this case for more than eight months, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Siwan, in connection with Nautan P.S.Case No. 14 of 2017, subject to the following conditions :- (1) One of the bailors shall be family member of the petitioner having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall mark his attendance in local Police Station in first week of every month till conclusion of trial, so that police may watch his conduct during the period of trial, failing which his bail bond shall be liable to be cancelled.
