The petitioner apprehends arrest in a case registered for the offences punishable under sections 506/34 and other allied sections of the Indian Penal Code. It is submitted that similarly situated co-accused Birendra Jha has already been granted anticipatory bail by order dated 27.09.2012 passed in Criminal Misc. No. 36908 of 2012. From the order sheet of the court below it appears that the prayer for anticipatory bail of the petitioner was rejected in the year 2010 and since then the petitioner is evading his arrest. On this ground alone, I am not inclined to grant anticipatory bail to the petitioner in connection with Runisaidpur P.S. case No. 50 of 2010 pending in the court of the learned Chief

Patna High Court Cr.Misc. No.40641 of 2015 (2) dt.05-10-2015 Judicial Magistrate, Sitamarhi. This application for grant of anticipatory bail is, accordingly, rejected.
