The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 467, 468, 506/34 of the Indian Penal Code.

By order dated 02.12.2019, petitioner was directed to pay a sum of Rs. 5 lacs by way of down payment and thereafter, the remaining amount be permitted to be paid in installments of Rs. 2 lacs per month.

However, today learned counsel for the petitioner handed over two cheques bearing cheque no. 004432 worth Rs.

Patna High Court CR. MISC. No.45418 of 2019(5) dt.05-02-2020 2/2 300000/- and cheque no. 004436 worth Rs. 200000/- to the leaned counsel for the opposite party no. 2 and further undertakes to make payment of remaining amount in equal installment of Rs. 2 lacs per month by 1st week of every succeeding month.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna City, Patna in connection with Alamganj P.S. Case No. 92 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

If the petitioner defaults for two consecutive occasions in making payment of monthly installments then the bail bond of the petitioner would automatically be cancelled. (Anjani Kumar Sharan, J) devendra/- U T
