The petitioner apprehends his arrest in Kazi Mahamadpur P.S. Case No. 376 of 2012, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that the SBI bank official found that some suspicious transaction of deposit and withdrawal has been done in the bank account of petitioner. It is further alleged that petitioner has withdrawn a sum of Rs. 5,59,000/- and when the complainant tried to get back the said withdrawn amount the petitioner denied the same. It is submitted that petitioner has not cheated anyone rather he has withdrawn the amount which were received by

Patna High Court CR. MISC. No.51314 of 2021(2) dt.27-06-2022 2/2 him by selling tobacco from purchaser of Tobacco of Jamui. Only on suspicion he has been made accused in this case. Counsel for the State however vehemently opposed the prayer for bail.

Considering the nature of accusation and the fact that entire transaction was made in the account of petitoner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
