2. The petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 281 of 2023 dated 31.05.2023 instituted under Section 395 of IPC against 10 unknown persons.
3. The prosecution story, in brief, is that The informant, Rahul Kumar, and his cousin brother were traveling to Bhagalpur for medical purposes and on 30.05.2023, at approximately 2:00 A.M., they were intercepted by 10 unknown miscreants. The miscreants used a country-made pistol to threaten them and looted three mobile phones, a bag, and a
Patna High Court CR. MISC. No.48044 of 2026(3) dt.29-07-2026 2/3 purse which included Rs. 5,000 from the informant, Rs. 3,000 from his cousin, and legal documents such as Aadhar and PAN cards. Following the robbery, the miscreants released the victims after they requested to be let go on medical grounds.
4. Learned counsel for the petitioner submits that the petitioner has nothing to do with the alleged occurrence and the petitioner has a clean antecedent and has falsely been implicated in this case.
5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.
6. Taking into account that the petitioner's name has been mentioned merely on suspicion and nothing has been recovered from the conscious possession of the petitioner, I am inclined to grant the petitioner benefit of anticipatory bail.
7. In view of the above facts and circumstances of this case, Let the petitioner above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten Thousand) with two sureties of the like amount each to the satisfaction of the Court below/the concerned Court in connection with Sultanganj P.S. Case No. 281 of 2023 dated 31.05.2023
